3Dconnexion Design Challenge II - 3D Mouse of the Future

Official Rules

NO PURCHASE NECESSARY TO PARTICIPATE.

1. ELIGIBLITY.
This Challenge is open to people 18 years of age or older at the time they submit an entry. The officers, directors, and employees of 3Dconnexion and its parent company, and their subsidiaries and affiliated companies (collectively “Sponsor”) and all advertising, promotion and judging agencies, persons engaged in the development, production or distribution of materials for this Challenge and each of their immediate family members or persons living in the same household (whether related or not) are not eligible to participate.

2. HOW TO ENTER.
To enter the Challenge, visit the Challenge website at www.3dconnexion.com/challenge and follow the instructions to complete the submission process. As part of the submission process, each entrant must download CAD files of the 3D Mouse controller cap and integrate the controller cap in to an interesting, creative and original 3D mouse design.  Entrants may use any 3D design software. Entries, including at least one image and a description of the design up to 500 words must be uploaded as directed on the Challenge website page. Entrants may submit multiple entries during the Challenge period.

3. CHALLENGE PERIOD.
The entry period for this Challenge will begin on July 11, 2011 at 9:00am Pacific Time and continue until August 31, 2011 at 11:59pm Pacific Time (the “Challenge Period”). During each month of the Challenge Period, entries will be reviewed for compliance and stored by 3Dconnexion ready for judging at the end of the month they were submitted in. The timeline for the following activities will take place on or around these dates:

  • July 11 – August 31, 2011: Entries accepted
  • August 9 , 2011: July Monthly Winners announced
  • September 9, 2011: August Monthly Winners and Grand Finalists announced
  • October 3, 2011: Grand Prize Winner announced

4. SELECTION OF MONTHLY WINNERS.
At the end of each month, sponsor will review and judge the eligible entries received and award 1st, 2nd and 3rd prizes. The monthly winning entries from July and August will be selected as “Grand Finalists”. Monthly winners will be selected and notified by email, at Sponsor's discretion. If the Winner does not respond to the notification attempt within 10 days from the first notification attempt, then such potential winner will be disqualified and an alternate will be selected.

5. COMMUNITY WILDCARD
As of August 17, 2011 the entry that has been “liked” the most on Facebook will be selected as a Community Wildcard and entered in to the grand final, providing that entry has not previously been selected as a monthly prize winner, in which case Sponsor may decide to select an alternative Community Wildcard or not.

6. SELECTION OF GRAND PRIZE WINNER.
The selection of the Grand Prize Winner will be determined by a public vote between September 9 and September 30 2011. A total of one Grand Prize Winner will be selected. On or about October 3 2011, the potential Grand Prize Winner will be selected and notified by email, at Sponsor's discretion. If the potential Grand Prize Winner does not respond to the notification attempt within 10 days from the first notification attempt, then such potential Grand Prize Winner will be disqualified and the entry with the second most public votes will be selected. In the event a potential Grand Prize Winner is disqualified for any reason, another Finalist's Entry will be chosen as the Grand Prize Winner according to the number of public votes.

7. JUDGING / JUDGES.
The selected Monthly Winners will be determined by a panel of judges from Sponsor organizations. The Grand Prize winner will be selected by a public vote on the Challenge website: www.3dconnexion.com/challenge

No cash equivalent or alternative individual prize will be awarded; provided, however, that 3Dconnexion reserves the right to, without any prior notice and at any time, replace any or all prizes within the prize package with similar products or the latest release of a product of the same category. Federal, state and local taxes are the responsibility of the winners. Prize packages will be delivered to the Finalists. Return of any prize package as undeliverable will result in forfeiture of the prize.

9. USE OF SUBMISSION.
By submitting your entry, you represent and warrant that your submission is your original creation without any contribution from any third party, and that your submission does not plagiarize or copy the work of any other person or otherwise violate any intellectual property rights or rights of publicity or privacy of any other person; does not contain lewd, obscene or pornographic content; and does not violate any applicable law in any country around the world. Sponsor may edit your submission as Sponsor deems necessary for any reason, and may publish or manufacture your submission as received or in edited form, in whole or in part, in connection with any publicity, marketing or promotion of this Challenge or the business or products of Sponsor, in any and all media, now known or hereafter created, in perpetuity throughout the world without further payment or consideration of any kind.

10. PUBLICITY RELEASE FOR WINNERS.
Acceptance of a prize shall constitute the Monthly Winners’ and Grand Prize Winner’s consent to Sponsor’s use of the name, address, profile, voice, photograph, audio, video, likeness and prize information of each winner for promotional or advertising purposes in any and all media, now known or hereafter created, in perpetuity anywhere in the world, without further payment or consideration of any kind, and the winner will sign and return any publicityrelease requested by Sponsor.

11. BINDING EFFECT.
These Official Rules are accessible from www.3dconnexion.com/challenge/guidelines.html and failure to comply with these Official Rules may result in disqualification. By participating in this Challenge you agree to be bound by these Official Rules. All federal, state and local laws apply.

12. GENERAL CONDITIONS FOR PARTICIPATION.
Sponsor’s decision is final on all matters related to this Challenge. Sponsor, and its affiliated companies are not responsible for incomplete, lost, late, delayed or garbled applications or emails, incorrect or inaccurate capture of entry information, including but not limited to technical malfunctions, human or technical error, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, so are or any combination thereof. Only the fully completed online application will be accepted. All applications submitted become the property of Sponsor. Sponsor reserves the right, without prior notice, to terminate this Challenge, in whole or in part, or modify this Challenge in any way, and for any reason, including without limitation, if Sponsor determines in its sole discretion, that fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Challenge. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the application or voting process or to be acting in violation of these Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Challenge is a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. By participating in this Challenge, entrant releases and agrees to hold harmless Sponsor and its affiliated companies from any and all liability with respect to acceptance, possession or use (misuse), or failure to use any matters arising out of or relating to this Challenge or any prize.

13. PERSONAL INFORMATION.
The information collected from entrants on the entry forms is subject to 3Dconnexion’s privacy policy, which is located at www.3dconnexion.com/privacy.

14. SPONSOR.
This Challenge is sponsored by 3Dconnexion with offices at Clarita-Bernhard-Str. 18, 81249 München, Germany.

15. COPY OF RULES / LIST OF WINNERS.
You may receive a copy of the Official Rules or a list of the winners by sending a self-addressed stamp envelope to 3Dconnexion “3D Design Challenge II” at the Sponsor’s address prior to October 31, 2011. Please specify on your outer envelope whether you are requesting Official Rules or list of winners.

16. DISPUTES
Participant agrees that (a) any and all disputes, claims and causes of action arising out of or connected with this Challenge, other than the administration of the Challenge, shall be resolved individually, without resort to any form of class action, and exclusively by a court having competent jurisdiction located in Germany; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Challenge but in no event attorneys’ fees; and (c) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights, to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OF EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with this Challenge, shall be governed by, and construed in accordance with the laws of Germany, without giving effect to any choice of law or conflict of law rules.
